Nonionizing Frequently Asked Questions

1. Who can be a medical director for a cosmetic facility?

A health professional with prescribing authority licensed in AZ that has attained at least 24 hours of didactic training in laser safety and whose scope of practice would involve cosmetic procedures.  The health professionals that may provide supervision of a laser technician are: Medical Doctors (M.D.), Naturopathic Medical Doctors (N.D., N.M.D), Nurse practitioners (N.P., F.N.P., C-N.P.), Doctors of Osteopathic Medicine (D.O.), and certain Dentist (D.M.D) that have attained specialized maxillofacial surgical training.

2. I’m a health professional licensed in this state, how do I show that I have attained the 24 hours of didactic training in laser safety?

If you are a medical doctor, nurse practitioner, naturopathic doctor, or doctor of osteopathy then you would complete the “Medical Director/Prescribing Official Application/Attestation” and attach the pertinent training and licensing information. 

If you are a registered nurse or physician’s assistant then you would complete the “Health Professional Training Application/Attestation” and attach the pertinent training and licensing information.   

There is no fee currently required for either process. 

3. How do I determine the fees for my facility?

Registration fees are determined by the various modalities of your equipment.  For example, if you have platform that has an IPL headpiece and laser headpiece, then that machine will count as 2 fee units.   If you have a machine that only has a laser or IPL or RF headpiece then that machine will count as 1 fee unit. 

If you are an industrial, rental/servicing laser and/or RF facility then your fees are determined by the range category you fall under (F2-F4 & F9-F11). This also applies to cinema theaters that have laser projectors.

For laser light shows or demonstration lasers the fee is one flat rate for any and all of your equipment of the calendar year you registered.

Tanning facility fees are determined by the number of beds not bulbs.

If your facility has diathermy or electrocoagulation units, they must be registered but carry no fee.

4. What cosmetic procedures can a physician’s assistant or registered nurse perform?

All of the cosmetic procedures that a certified laser technician can perform.  Please see the list of procedures in R12-1-1438.01 (F).

5. Can my facility be mobile?

Yes, as long as it complies with all the Agency rules especially Article 14.

6. What types of non-ionizing technology does the Agency regulate?

The Agency regulates class IIIB and IV lasers: medical (including “cold” therapeutic units), cosmetic, and industrial use.  We also regulate class II surgical devices that require a prescription from a licensed health professional (M.D., D.O., N.P., N.M.D.).  Examples of class II surgical devices would be:  hyfrecators /electrocautery, “Bovies” and other electrosurgical units that use RF, body contouring or fat reducing RF/lasers, and “cold”/therapeutic lasers.

Ultrasonic and acoustic wave are not currently regulated by this Agency. 

Neither are MRI or NMR devices.

7. Do I need to send a Non-Ionizing Facility Registration form with every amendment?

No, please read the non-ionizing registration instructions in its entirety for your type of facility.

8. Is my corporation file number the same as my tax identification number?

No, your corporation file number is issued by the Arizona Corporation Commission.  If you do not know what that number is you may search for it here:  http://ecorp.azcc.gov/Search .   If you are a laser light show you may provide the state and corresponding file number in which your company is incorporated.

LI = INDUSTRIAL LASER (F2 – F4)

LL = LASER LIGHT OR DEMONSTRATION LASER (F5)

LM =  MEDICAL LASER (F6)

LD = DENTAL LASER (F6)

LV = VETERINARY LASER (F6)

MC = MEDICAL & COSMETIC LASER (F6)

LC = COSMETIC LASER (F7)

RM = MEDICAL OR COSMETIC RADIOFREQUENCY (F8)

RF = INDUSTRIAL RADIOFREQUENCY (F9 - F11)

MW = INDUSTRIAL MICROWAVE (F9-F11)

EC = ELECTROCAUTERY / DIATHERMY (F12 – F15)
